The International Chamber of Commerce has published. The long form clause of the ICC’s draft force majeure clause is quite broad, providing for events ranging from war, invasion, revolutions and riots to acts of authorities such as currency restrictions, seizure of works, nationalization, etc.
In order to address this uncertainty, the Government of India released certain executive directives/notifications[5] over the course of the pandemic with respect to the consideration of the Covid-19 pandemic and subsequent lockdowns as force majeure events in commercial contracts (particularly in connection with public-private partnership contracts). In weighing the same against the facts and circumstances of individual cases, Indian courts have laid emphasis on the fact that for valid INVOCATION of the force majeure clause, the impossibility of performance of contractual obligations, beyond the scope of reasonable and practical alternate means, must be demonstrated.
This video has given me food for thought. It is increasingly obvious that the points reduction was a reactionary, arbitrary decision by the EPL with no precedent. By their own admission this will be changed in the summer. If Everton are relegated as a direct result and further cases of PSR overspends do not result in points reduction I wonder if EFC could sue the EPL for automatic reinstatement (ie promotion). Just a thought.

So true what he’s saying! It’s almost like being back at school where there was certain teachers who’d dish out an hour of detention, but other teachers who’d just give you lines to do at home, then the nice ones who’d just tell you off! Nobody knows what the relation is between the rule breaking criteria and the punishment.

It’s a real shame that we couldn’t justify keeping this lad. I understand more now why we didn’t but it’s a shame we lost his leadership and passion for the club. He’s a good player too obviously.

This came about after the PL checked their spreadsheet and pinpointed where they could, flex their authority to show they don't need the government's independent commission to do Mastres and co out of a job.
