The South West London Nursery Company has submitted a planning application to Hammersmith and Fulham Council concerning a property at 163 New King’s Road in London.

The site was previously granted planning permission in 2012 for conversion from a private members’ club into a day nursery.

The original approval included a number of specific conditions, among them requirements for sound insulation and odour abatement measures.

Subsequent planning variations have already seen some conditions removed, including an odour abatement requirement in November 2025.

Now, the applicant is seeking to remove condition 10, which requires the submission of sound insulation details for the commercial parts of the premises that adjoin residential units.

According to the proposal, the nursery wants the noise insulation condition removed because an acoustic survey cannot be carried out without access to the flats above, there are no records showing how the building was constructed, and the nursery has been operating for more than 10 years without any noise complaints.

If approved, this change would mean the nursery is no longer required to provide evidence that sound insulation is in place between the nursery and neighbouring homes.

The application, registered on Monday, January 19 and validated on Tuesday, January 20, remains under consideration by the council’s planning team.

The current application follows a series of previous planning changes for the site, including permission for internal alterations, the formation of a play area in the front lightwell and the installation of an external fire escape.
